Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and Fetope LLC ("FE to PE Prep", "we", "us", or "our"), which operates fetope.com and the related study products and services (together, the "Service"). By creating an account, purchasing an access pass, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, to create an account or make a purchase. The Service is intended for adult exam candidates and is not directed to children under 13. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
2. Your account
- You are responsible for the information you provide and for keeping it accurate. You must provide a valid email address.
- You are responsible for safeguarding your password and for all activity under your account. Notify us promptly at [email protected] if you suspect unauthorized use.
- Accounts are personal to a single individual and may not be shared, sold, or transferred, except under an enterprise arrangement we agree to in writing.
3. The Service and your license to use it
Subject to these Terms and your active access (where required), we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service and its content for your own exam preparation and personal study. You may not use the Service for any other purpose. All use is also subject to our Acceptable Use Policy.
4. Access passes, pricing, and payment
- One-time, time-boxed passes. The Service is sold as per-exam access passes for a fixed duration (for example, 1, 3, 6, or 12 months). Each pass is a one-time payment. There is no subscription and no automatic renewal — access simply ends when the pass expires, and there is nothing to cancel.
- Stacking and scope. A pass grants access to the specific exam you purchase it for. Buying another pass for the same exam extends your access by adding time onto your current expiry; a different exam requires its own pass.
- Prices and promotions. Prices are shown on the pricing page in U.S. dollars and may change at any time, but a change will not affect a pass you have already purchased. Discounts and promotional codes are applied as described at checkout and may be withdrawn or modified.
- Payment processing. Payments are processed by Stripe, Inc. We do not receive or store your full card number. Your purchase is also subject to Stripe's terms. You are responsible for any taxes that apply to your purchase.
- Free tier. We may offer a limited free demo and a limited free allowance of certain features (such as the AI tutor). Free features are provided as-is and may change or end at any time.
5. Refunds
Purchases are governed by our Refund Policy, which is incorporated into these Terms. Please read it before you buy.
6. Intellectual property
The Service and its content — including the question banks, study handbooks, explanations, figures, software, design, and branding — are owned by Fetope LLC or its licensors and are protected by copyright, trademark, and other laws. Except for the limited license in Section 3, we reserve all rights. You may not copy, reproduce, distribute, republish, scrape, sell, sublicense, or create derivative works from the Service or its content, and you may not use it to build, train, or improve any competing product or any machine-learning model.
Exam names and third-party marks (such as NCEES, FE, PE, and named codes and standards) are the property of their respective owners and are used only nominatively to describe the exams we help you prepare for. See our Disclaimer for our non-affiliation statement. Our handling of copyright complaints is described in our Copyright & DMCA Policy.
Your feedback. If you send us suggestions or feedback (including question reports), you grant us a perpetual, worldwide, royalty-free license to use them to improve the Service, without obligation to you.
7. The AI tutor
The AI tutor is an optional, automated study aid. Its responses are generated by a third-party AI provider and may be inaccurate, incomplete, or out of date. The AI tutor does not provide professional engineering, legal, financial, or other professional advice, and you should independently verify anything important against authoritative references. Do not submit confidential or sensitive personal information to the AI tutor. Your inputs are processed as described in our Privacy Policy. You must not use the AI tutor to cheat on, or to gain an unfair advantage during, any live, proctored, or actual examination.
8. No guarantee of outcomes
The Service is a study resource. We do not guarantee that you will pass any exam, achieve any score, or obtain any license or certification. Exam outcomes depend on many factors outside our control, and individual results vary. See our Disclaimer.
9. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that content is accurate or complete. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
10. Limitation of liability
To the fullest extent permitted by law, Fetope LLC and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or exam outcomes, arising out of or relating to the Service. Our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD 100. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Fetope LLC and its owners, employees, and suppliers from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.
12. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or the Acceptable Use Policy, if required by law, or to protect the Service or other users. If we terminate your account for a material violation, you will not be entitled to a refund of any unused access. Sections that by their nature should survive termination (including Sections 6 and 9–14) will survive.
13. Changes to the Service and these Terms
We may modify or discontinue features of the Service at any time. We may also update these Terms; if we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of Ohio, USA, without regard to its conflict-of-laws rules. Before filing any claim, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days. If the dispute is not resolved, you and we agree that it will be brought exclusively in the state or federal courts located in the State of Ohio, and you consent to the jurisdiction of those courts, except where applicable law gives you the right to bring a claim elsewhere.
15. Miscellaneous
- Entire agreement. These Terms, together with the policies they reference, are the entire agreement between you and us regarding the Service.
- Severability. If any provision is found unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
