Terms of Service

These Terms are an agreement between you and Fetope LLC ("FE to PE Prep", "we", "us"), which runs fetope.com (the "Service"). By creating an account, buying a pass or using the Service, you agree to them; if you do not agree, do not use the Service. Our Privacy Policy explains how we handle your information.

1. Who can use it

You must be at least 18 years old (or the age of majority where you live, if that is higher). If you use the Service for an organization, you confirm that you can bind it to these Terms.

2. Your account

Keep your details accurate and your password safe; you are responsible for all activity on your account. Tell us at support@fetope.com if you suspect misuse. An account is for one person and may not be shared, sold or transferred, unless we agree otherwise in writing (for example, for a team).

3. Passes and payment

• Each pass is a one-time payment for a fixed period of access to one exam (for example 1, 3, 6 or 12 months). There is no subscription and nothing renews: access simply ends.
• Buying another pass for the same exam adds its time to your current access. Another exam needs its own pass.
• Prices are in U.S. dollars and may change, but never for a pass you have already bought. Discounts apply as shown at checkout and may be withdrawn.
• Stripe processes payments; we never see your full card number. You are responsible for any taxes that apply.
• Pass Promise. If you buy a 3-, 6- or 12-month pass for an exam before your exam date, and by that date you finish at least two full-length mock exams and reach a readiness score of 70 or more for that exam, both as counted on your account page, and you then do not pass, you can claim the Pass Promise from your account page within 90 days of your exam date. We then extend your access to that exam free until your retake date, for at most 6 months from your claim. One claim per exam per account. We may ask to see your official result, and may refuse or reverse a claim that does not meet these terms. The Pass Promise extends access only: it is not a refund and has no cash value. The readiness score measures your practice, not your chance of passing.
• Free features, such as the demo questions and the free AI-tutor allowance, may change or end at any time.

4. Refunds

Refunds follow our Refund Policy, which is part of these Terms.

5. Using the Service

While you have access, we give you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own exam study. You may not:

• share, sell or transfer your account or login;
• copy, republish, sell or share our content beyond your own study, except as section 6 allows for public pages;
• scrape, bulk-download or use bots or scripts to access the Service, except search engines and AI crawlers that follow our robots.txt on pages that need no sign-in;
• use content that needs an account or a pass to train, fine-tune or test a machine-learning model, or use any of our content to build a competing product;
• get around paywalls, limits or security, or probe, attack, reverse-engineer or disrupt the Service;
• use the Service or the AI tutor to cheat on a real exam; or
• break the law, harass or impersonate anyone, send spam, or submit harmful content.

6. Our content

The Service and its content (questions, explanations, handbooks, figures, software and design) belong to Fetope LLC or its licensors and are protected by copyright and other laws. We reserve all rights not granted in section 5.

Public pages. Pages anyone can open without signing in (such as our guides, free practice questions, formula sheets and pass-rate tables) may be indexed by search engines, quoted with a link back to the page, and used by AI systems to answer questions and for AI training, as our robots.txt file states. This does not allow copying them into a competing study product.

Other marks. Exam names and other marks (such as NCEES, FE, PE and the names of codes and standards) belong to their owners and are used only to describe the exams we help you prepare for.

Copyright complaints. If you believe something on the Service infringes your copyright, email dmca@fetope.com with the work, where it appears on the Service, and your contact details.

Feedback. If you send us suggestions or reports, you give us a perpetual, worldwide, royalty-free license to use them to improve the Service, with no obligation to you.

7. A study aid, not advice

FE to PE Prep is an independent study resource. It is not affiliated with, endorsed by or sponsored by NCEES or any standards organization, and our questions are our own, not actual exam questions. The Service is for exam preparation only: it is not professional engineering advice, and you must not rely on it for real design or professional work. Content can contain errors and standards change, so check anything important against official references, and please report errors so we can fix them. The AI tutor's answers can be wrong. We do not guarantee that you will pass any exam or get a license; results depend on many things outside our control.

8. No warranties

To the fullest extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, express, implied or statutory, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that the Service will be uninterrupted or error-free, or that its content is accurate or complete. Some places do not allow these exclusions, so some may not apply to you.

9. Limitation of liability

To the fullest extent the law allows, Fetope LLC and its owners, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or exam outcomes, arising out of or relating to the Service. Our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or USD 100. Some places do not allow these limits, so some may not apply to you.

10. Indemnity

You agree to indemnify and hold harmless Fetope LLC and its owners, employees and suppliers from any claims, damages, liabilities and expenses (including reasonable attorneys' fees) arising out of your misuse of the Service, your breach of these Terms, or your violation of any law or third-party right.

11. Suspension and termination

You may stop using the Service at any time. We may suspend or end your access if you break these Terms, if the law requires it, or to protect the Service or other users. If we end your access for a material breach, you will not get a refund for unused access. The rules in section 5, and sections 6 to 10, 13 and 14, continue to apply after your access ends.

12. Changes

We may change or discontinue features of the Service at any time. We may also update these Terms; for material changes we will update the date at the top and, where appropriate, tell you in another way. Using the Service after changes take effect means you accept them.

13. Governing law and disputes

These Terms are governed by the laws of the State of Ohio, USA, without regard to its conflict-of-laws rules. Before filing any claim, you agree to contact us at support@fetope.com and try to resolve the dispute informally for at least 30 days. If it is not resolved, it will be brought only in the state or federal courts located in the State of Ohio, and you consent to their jurisdiction, except where the law gives you the right to bring a claim elsewhere.

14. General

These Terms and the policies they refer to are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. Not enforcing a part is not a waiver of it. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.
