Codes of Ethics and Public Welfare

The NCEES Model Rules, the paramount duty to public health and safety, competence and conflict-of-interest obligations, licensure, and a method for resolving ethical dilemmas.

Engineering is treated as a profession, not merely an occupation, because society grants engineers special knowledge, special privileges, and in return demands special responsibilities. The FE exam tests this contract directly: roughly two to three questions come from Ethics and Professional Practice, and they are almost always free points if you internalize one idea — that an engineer's obligations are ranked, and the public sits at the top. The authoritative source is the NCEES Rules of Professional Conduct (Section 240 of the Model Rules) reproduced in the FE Reference Handbook under Ethics and Professional Practice. These are not questions you compute; they are questions you reason, and the reasoning is structured.

The three obligations, with the public paramount

The Model Rules organize professional conduct into three sets of obligations — to the public, to employers and clients, and to other licensees — and one ranking is codified above all: the duty to the public is paramount. When a duty to the public collides with any other duty, the public wins. The very first rule states that a licensee's first and foremost responsibility is to safeguard the health, safety, and welfare of the public, so if a question pits a client's schedule or an employer's profit against a credible public-safety hazard, the public wins every time. The Model Rules list obligations to employers/clients and to other licensees as separate sections but do not assign a binding precedence between those two; in practice, employer/client duties tend to outrank collegial courtesy toward another engineer, which is a useful exam heuristic rather than an explicit codified ranking.

Worked examples

Overruled safety judgment

Problem. You are a chemical engineer who determines that a pressure-relief valve on a reactor is undersized and could fail to protect against runaway pressure. You report it to your supervisor, who overrules you for cost reasons and orders the design to proceed unchanged. Under the NCEES Model Rules, what is your obligation?

Solution. Step 1 — Identify the conflict: the duty to protect public health and safety (Obligations to the Public) versus loyalty to the employer's cost decision (Obligations to Employer/Client). Step 2 — Rank the duties: public welfare is paramount and outranks employer loyalty. Step 3 — Apply the specific rule: when a licensee's professional judgment is overruled under circumstances that endanger the public, the licensee must notify the employer or client AND such other authority as may be appropriate. Final answer: Document the analysis, formally notify the employer in writing, and if still overruled escalate to the appropriate authority (e.g., the regulatory body or licensing board). Do NOT stay silent and do NOT simply resign without raising the safety issue. Sanity check: the chosen action is the one that protects the public, consistent with the public-first hierarchy.

Work outside your competence

Problem. A coordinating engineer asks you, a process engineer, to sign and seal the structural foundation calculations for a new distillation column because the structural engineer is on leave and the schedule is tight. You have not practiced structural design since school. What is the ethical action?

Solution. Step 1 — Identify the rule: licensees undertake assignments only when qualified by education or experience in the specific technical field, and shall not seal documents dealing with subject matter in which they lack competence. Step 2 — Apply it: foundation structural design is outside your area of competence, so you cannot seal it regardless of schedule pressure. Step 3 — Choose the action: decline to seal, and recommend that a qualified structural PE prepare or review and seal that technical segment. A coordinating engineer may assume responsibility for the whole project only if each technical segment is sealed by the licensee responsible for it. Final answer: Decline to seal the structural calculations; have a qualified structural engineer seal that segment. Sanity check: sealing outside competence is an explicit ground for disciplinary action, so declining is the only compliant choice.

Gift from a vendor

Problem. While evaluating bids for a $2 million heat-exchanger package, you are offered free tickets worth several hundred dollars to a sporting event by one of the bidding vendors. How should you respond under the Model Rules?

Solution. Step 1 — Identify the rule: licensees shall not solicit or accept gratuities, directly or indirectly, from contractors or their agents in connection with work for employers or clients, and must disclose anything that could appear to influence their judgment. Step 2 — Recognize the appearance problem: accepting a gift from a bidder during an active evaluation creates at least the appearance of a conflict of interest, biasing the procurement. Step 3 — Choose the action: decline the tickets; if a token item was already received, disclose it to your employer. Final answer: Politely decline the gift to avoid both actual and apparent conflict of interest. Sanity check: the safe default whenever judgment could appear influenced is to decline and disclose — consistent with the conflict-of-interest rule.
